1. Acceptance of Terms

By installing, accessing, or using QuizZap (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

2. Description of Service

QuizZap is a Shopify app that provides:

• AI-powered quiz generation for Shopify stores
• Product recommendation engine based on customer quiz responses
• Customizable quiz widget for storefronts
• Analytics and insights on quiz performance

3. Eligibility

To use QuizZap, you must:

• Be at least 18 years old
• Have a valid Shopify store
• Have the authority to bind your business to these Terms
• Comply with all applicable laws and Shopify's Terms of Service

4. User Responsibilities

You agree to:

5. Service Limitations and Rate Limits

To ensure fair use and system stability, we implement:

• AI Quiz Generation: 5 requests per minute per store
• Product Recommendations: 30 requests per minute per store
• Public Quiz Access: 100 requests per minute per store

5.2 Service Availability

• We aim for 99.9% uptime but do not guarantee uninterrupted service
• We may perform maintenance with or without notice
• We reserve the right to modify features with reasonable notice

6. Billing and Payment

6.1 Subscription Plans

QuizZap offers various subscription plans with different features and pricing. All billing is handled through the Shopify App Store.

6.2 Payment Terms

• Subscription fees are charged according to your selected plan
• Payments are processed through Shopify's billing system
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice

6.3 Free Trial

If a free trial is offered, you may cancel before the trial ends to avoid charges. Upon trial expiration, your subscription will automatically begin unless canceled.

6.4 Refunds

Refunds are handled according to Shopify's refund policy. Contact us at support@quizzap.com for refund requests.

7. Intellectual Property

7.1 Our Rights

QuizZap, including all software, designs, text, graphics, and other content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App.

7.2 Your Content

You retain ownership of all content you create using QuizZap (quizzes, questions, answers). By using the App, you grant us a limited license to use your content solely to provide the service.

7.3 AI-Generated Content

Content generated by our AI features is provided to you for your use. However, AI-generated content should be reviewed and modified as needed to ensure accuracy and appropriateness.

8. Data and Privacy

Your use of QuizZap is subject to our Privacy Policy. By using the App, you consent to our collection and use of data as described in the Privacy Policy.

9. Termination

9.1 By You

You may terminate your use of QuizZap at any time by uninstalling the App from your Shopify store. Upon uninstallation:

• Your subscription will be canceled
• Your data will be scheduled for deletion within 30 days
• You may lose access to quiz data and analytics

9.2 By Us

We may suspend or terminate your access to QuizZap for:

• Violation of these Terms of Service
• Abusive or excessive use of the service
• Non-payment of fees
• Fraudulent activity or security threats
• Legal or regulatory requirements

9.3 Effect of Termination

Upon termination:

• Your license to use the App terminates immediately
• You must cease all use of the service

10. Disclaimers

QuizZap is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose

• Accuracy or reliability of results

10.2 AI Disclaimer

AI-generated content is provided as a tool to assist you. We do not guarantee:

• Accuracy of AI-generated quiz questions
• Quality or appropriateness of AI suggestions
• Effectiveness of product recommendations

You are responsible for reviewing and approving all AI-generated content before use.

11. Limitation of Liability

To the maximum extent permitted by law, QuizZap and its affiliates shall not be liable for:

• Loss of profits, revenue, or sales
• Loss of data or business interruption
• Indirect, incidental, special, or consequential damages
• Damages resulting from AI-generated content
• Service interruptions or downtime

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify and hold harmless QuizZap, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:
